It's not automatic that a horse suspended in Canada is also suspended in the USA.  Plus he does have new owners since the infraction and that may matter.  I'll bet they find a way to race him.

Does the rule-----US and Canada-----clearly address this situation-----a private sale that took place immediately after the horse came up positive (from out of competition testing)? This should be very interesting.

If I was the owner and looking to get my money back I’m not sure I’d fight to get the horse to be allowed to race.  I’d go to court and say I bought a horse that is now suspended because of the previous owner. If he’s racing they may say buyer beware but if there is no way to recoup money then I’d say the new owner would win.

Since out of comp testing is done with the same authority as on the grounds and race day testing, I am sure the value of the the test will be the same. If it were a claim instead of a private purchase it could be voided.
 It would be in the best interest of both parties to come to a further agreement. Avoiding a civil claim and maybe a claim of criminal intent to defraud could be possible.

Coming to an agreement would mean someone would have to admit they administered the DPO, and therefore, nobody is stepping up to take that responsibility of guilt.. especially 3 HOF's like Yves, Moreau and Sylvain,, unless someone comes fwrd w/info or proof there won't be a settlement of any kind.!!

it was done 5 days before the NA Cup final.

I don't think Pollock wants to pay lawyers to fight about the original sale.  The money he spent obviously means nothing to him considering how much he has put in the past couple of years. I think he wants the action and fun of watching his horse's race.  If the horse is sound enough to race, I think he'll spend his money trying to get him "unsuspended" here in the States.
