Ruling Text: A HORSE TRAINED BY YOU RACED IN THE 9'TH RACE WITH A DRUG PRESENT IN ITS SYSTEM FINDINGS AND ORDER DATED 02/28/2006 ORDERED THAT THE DECISION IS TO UPHOLD THE VIOLATIONS AS CHARGES AND THAT THE SIXTY (60) DAY SUSPENSION AND ONE THOUSAND DOLLAR ($1,000) FINE ARE TO BE SERVED AMENDED F&O 3/9/06 MODIFIED TO REVOCATION AND ANY RIGHT TO PARTICIPATE AS A TRAINER. INELIGIBLE TO REAPPLY FOR A LICENSE FOR A PERIOD OF NOT LESS THE NINE (9) MONTHS FROM THE EFFECTIVE DATE OF THE REVOCATION. IT IS HEREBY ORDERED that the harness racing license of Joseph Guarino(and any continuing rights to participate in pari-mutuel harness racing) in the State of New York is revoked effective December 5, 2007 and that Joseph Guarino shall be ineligible to apply for a racing license for a period of not less than nine (9) months from the effective date of the revocation. IT IS FURTHER ORDERED that during the period of revocation, he shall not participate in New York State pari-mutuel horse racing, directly or indirectly, he shall be denied the privileges and use of the grounds of New York State racetracks, and he shall be forbidden to participate in any share of purses. No horse shall be allowed to participate in pari-mutuel racing and is denied the privileges of the grounds (i) that is owned or trained by Joseph Guarino, or by those employees or agents who continue to serve as his or her agents or employees during such period of revocation, or (ii) for which Joseph Guarino is making arrangements with any owner, directly or indirectly, to care for, train, enter in races, invoice, collect fees or other payments, employ workers, or otherwise handle the horse. This shall not preclude agents or employees of Joseph Guarino, who are not serving as such during the period of his revocation, from participating in pari-mutuel racing as owners, trainers, and grooms, as long as they are licensed and perform those duties consistent with the rules and regulations of the State of New York.

Ruling Text: Having waived your right of appeal, your license to participate in harness racing is suspended for the period of one year from March 14, 2010 through and including March 13, 2011 and you are fined the sum of two thousand five hundred dollars ($2500) because the horses, �Radiant Hall� who finished 1st and �West Gun� who finished 3rd, trained by you, competed with excess pre-race TCO2 levels at Yonkers Raceway on January 14, 2010 and January 16, 2010 respectively, in violation of 9 NYCRR �� 4120.13 and 4120.4. You are required to return the purse money from both races to Yonkers Raceway. During the period of his suspension, you shall not directly or indirectly participate in New York pari-mutuel horse racing and are denied the privileges and use of the grounds of all racetracks. You are forbidden to participate in any share of purses or other payment. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, further, that is (a) owned or trained by you or any individual who serves as your agent or employee, during this suspension; or (b) for which you, during this suspension, are involved, directly or indirectly, with its training including arrangements made to care for, train, enter, race, invoice, collect fees or payments, manage funds, employ or insure workers, provide advice or information, or otherwise assist with any aspect of the horse�s training.
