I just watched the replay.  Hard to tell if he had the equiptment but they refunded the money bet on him and he made the gate fine.  They must have figured out that they put the wrong horse in otherwise no refund.

Race 11 Erv horse was scratched race 11. That horse raced in Race 3. So they mixed horses- no idea how everyone missed that. Hard to comprehend.
