What is the arguement here? Over 3rd place?? Why would the 2nd place finisher want to sue. Strong Poison the winner WAS listed on the program as getting lasix. I deleted my copy of the program so I don't remember if McSeaside was listed as getting the med or not but the results do show they both got it. So maybe they may have some kind of case against the 3rd place finisher but no one is getting sued. This thread is basically BS and just hype for Burke and Hoosier management haters
Even if you disqualified the filly that got lasix, millers filly would have been 4th instead of 5th. If you wanted to throw a fit, cal the commission and see if they’ll disqualify them and you’ll make 5k off the phone call. But getting a lawyer for 5k and it’s been decided by a state entity? Fucking stupid.
1. Arguing on money lost during a 115k race where you finished second is probably not worth having a call to the lawyer. 2. Lasix as used by the state and going to presented as such by any lawyer is to stop a horse from bleeding, a horse that wasn’t bleeding and wasn’t on lasix isn’t going to get a real improvement from lasix (arguing that lasix is a performance enhancer for non bleeders in court would be a bad idea)3. The vet and commission are at fault, and the bettors would have a case if Hoosier handled anything at all and the public wasn’t notified for first race lasix.
