Now, after nearly five months of fighting to prove something that should never have been in question, Brian José Morales García is finally home.
Morales returned to the United States Sunday after the Justice Department reached an agreement with his attorneys allowing him back in.
His lawyers had produced a certified State of Colorado birth certificate, hospital records, and sworn affidavits confirming what Morales says he told federal authorities from the very beginning: He was born in frickin' Denver.
His nightmare started in April when Morales was a passenger in a truck stopped by Texas law enforcement. After they detained him, he says he told them he was a U.S. citizen and that his birth certificate and Social Security card were at his home in Austin.
They wouldn’t let him go get them. Instead, Morales was thrown into federal immigration custody.
According to his lawsuit, authorities pressured him to sign paperwork claiming he had illegally crossed the border -- something he insists never happened.
He says he finally told them what they wanted to hear because he was terrified of spending months locked up and desperately wanted to get back to his wife and newborn daughter who were in Mexico.
Then ICE deported him.
DHS insisted at the time that its records showed Morales was in the country illegally and that he had “admitted” entering illegally. His attorneys kept fighting and eventually produced the additional records that forced the government to let him return.
His civil rights lawsuit against the federal government is still going -- as it should be.
An American citizen told his own government where he was born. The government didn’t believe him, threw him out of his own country, and it took nearly five months and a team of lawyers to get him back in.
