question about a positive and returned purse money

So a horse gets a check - checks sent out, 5% to driver and 5% to trainer.

Horse has a positive and the ruling states that the purse money needs returned by however many days.

Does the money returned -- include the 5% earned by the driver ? Or does the owner or trainer have to return that 5% ?

Only in some cases.  Lexington doesn't take it back from drivers.  Some tracks do it just depends.  It's all according to who it is as well.  If your a top ten driver your probably not getting charged.  I know Georgie Brennan never had to give back all the Lou Pena money.

The driver percentage is best worked out between the trainer and owner. The last thing you want to do is piss off your driver! If a trainer races regularly, then they will debit his account. At least this has been my experience with it.
