PA Code Title 7: 205.401(11) 205.501(14) 205.456 Mr. Dunning drove #4, ELM GROVE QUAIL, in the 3rd race on July 2, 2023, at Harrah’s Philadelphia. After the half, and continuing to the middle of the final turn, Mr. Dunning drove in a careless and/or reckless manner and failed to maintain reasonable control of ELM GROVE QUAIL as ELM GROVE QUAIL repeatedly ran up on and into the back of another driver. Mr. Dunning is fined $500 (fines are due within ten days of ruling). Mr. Dunning’s driver’s license is immediately placed on a conditional status and while in a conditional status, Mr. Dunning will only be allowed to drive in non-purse races. Mr. Dunning may petition the Harrah’s Philadelphia judges to have his license removed from conditional status no sooner than December 1, 2023 and no later that December 31, 2023 if he meets the following requirements: 1. Drives at least 20 “satisfactory” qualifying races (a minimum of ten must be in front of the judges at Harrah’s Philadelphia). 2. Is issued no rulings for driving violations during this time. 3. Gathers and submits letters of recommendation of at least six drivers from Harrah’s Philadelphia. Since there is no drivers’ committee at Harrah’s Philadelphia, the drivers eligible to submit such a recommendation must be in the top twelve of the Harrah’s Philadelphia drivers’ standings (sorted by wins) as of November 15, 2023. If Mr. Dunning fails to meet these conditions by December 31, 2023; his driver’s license will be returned “qualifying/fair” status.
