Not sure but didn't he plead guilty ? How do you appeal something you chose? If he says his lawyer was bad, then his appeal would mean he wants to go to trial?  Didn't he agree to cooperate for a chance at a lighter sentence which the prosecutor asked the judge to go light on Nick? Makes no sense.  I hope the judges toss it.
