Ohio --- don't appeal will reduce penalty.
« on: January 13, 2023, 10:52:42 AM »
Last few weeks I have noticed more than ever that Ohio likes to play the game of if you don't bother us you can get a reduced fine/days.

Not sure how I feel about that -- It's like there is a due process and you have the right to appeal, but as in most cases your gonna lose so we will dangle a carrot of reduced penalties so as to not annoy us. But if you do appeal, in many cases its double the fine.

Any thoughts / Opinions

the decisions on appeals has resulted over time to be a lesser period of time and a smaller fine, so - tho it seems that due process is being circumvented ... they were already operating that way, so why is it any different than the past ?

I don't like it at all. The judgements are made by judges who are controlled by the commission and not allowed to think outside the box and to get a real hearing you must appeal.  It's certainly immoral if not illegal.

How do you beat the commission, most of the judges I know hate to do anything but watch the race, they don't want to make judgements, this just makes their job easier. Less appeals

If you watch the appeals it looks like the trainer appeals so they can keep racing and take their days when it is better for their stable.
