Now you've hit the nail on the head. If an owner knowingly uses a banned trainer, through deceptive channels, for the purpose of making an illegitimate profit - that is Fraud.
It may take something like a joint class action lawsuit for fraud, seeking monetary compensation for lost income, brought by some coalition of bettors and or trainers/owners, against these owners that profit from said fraud, to really shock this broken system.
As with most things harness, the current policing infrastructure is inadequate to handle the problem, and the solution may lie in the state courts.

Bluechip should be boycotted for supporting marks.
Marks will still get his pockets lined from Gillis an Bongiorno. He lined them up
With owners an sauces them up for a percentage.

That is not as far fetched as it sounds. All you would need is a few big time buyers to announce in unison that they were boycotting the consignment of breeders using beards. I would bet others would follow which could put a dent in their sales.

In NY, the so so not commited the owner must pay $19.00 to enter a horse. This is to offset the cost of testing and policing that the mutual tax once paid.
 So, since it produces no revenue for the state, it has no political power. In short, nobody cares. The game is wide open.

I think some commissions dump a lot of it down the drain. I agree, owners need to be held accountable for using banned trainers. It's not like they don't know what's going on.

Your polly right, Parked. I remember about 10 years ago when they initially added a $10.00 stater fee. It was in reaction to Cornell University refusing to do any testing because the state was behind in their bill. After it was all settled,  the Lab admitted they had not done one test for many months.
