This was part of the bid process and now they are trying to back out. Not Happening!

Interesting. I guess this may come down to an argument about how each side "interprets" the contract they signed. As usual, the horse racing industry may be direct or collateral damage here. Most often, they have themselves to blame. Not sure about this one, but if the least important party is going to take a hit, it will be the horse racing industry. The casino company should NOT be allowed a second bite at the big apple (no pun intended, LOL).
