At this point can governors shutdown once they open? They have emergency power and the SC in WI already spoke what they thought about a extension...wasn't happening. County boards in IL are voting to open despite what JBP has to say. Agree things will get worse in paper with more testing it's a given. However on the other side of the hemisphere down under cases are low as they get into fall season. That's encouraging for now? If racing can start and show they can rCe and not be a covid hotspot why close? Gulfstream, TB, and Oaklawn did just fine.

I would think this is matter for State law in each State so varies. Wisconsin Supreme Court (conservative) ruling would be on Wisc law issue. It wouldn't be precedent for other States although logic applied might be applicable elsewhere.

Yonkers in Westchester will be the last to open except Manhattan of course . Looks like mid June Tioga will open even though Gural says it’s not in his best interest.

Gural is a phony. He made sure to publicize the BS about him opening even though its not in his best interest only to stroke his own ego.

Cuomo is smarter than Trump but made two bad calls:

1. "His health Dept. told nursing homes early on they had to take co-19 patients that fit nursing home admission criteria  from hospitals if they were being released from hospital." Bad call! It spreads like wild fire in these homes. Poor nursing home workers are paid crap and it's like being told to charge that machine gun nest to be in these places now.

2. The obsession  on ventilator's was misplaced. There impt but if only 1/5 co-19s that go on them survive, not as impt as initially made out. Ppe and testing a lot more impt.

I think Wisconsin's logic should be applied/applicable elsewhere. Emergency orders should be just that "Emergency's" I.E. Forest fires or Earthquakes. something short term.

This has been ongoing for months and probably will last many more months or possibly years, and thus should be legislated by the state legislator's, not Governors acting like dictators.

All we heard from the media the last 2 years was Trump was turning into a authoritarian strongman/dictator. And now we have 50 of them (governor's) and the media is rooting them on...…

I'm sure a lot of the Governor's think what they are doing correct but What's the old saying "The road to hell is paved with good intentions."

Wisconsin is in a bad place now with the recent court ruling, and they do need some set of rules.

But we are a nation of law's not dictators.

I haven't followed other States real closely but somewhat surprisingly NY has State law that gives Cuomo quite wide authority. Section 29-a of Article 2-b of the Executive Law gives the Governor authority to issue any directive necessary to cope with a disaster.

I believe it was added or amended this year. I doubt it would be challenged successfully if a lawsuit was brought on whether this constitutes a disaster.  I suppose someone might litigate questioning what is necessary.  I personally don't think there would be much chance of success there but who knows.

I read this in NY as saying horsemen had better use whatever lines of communication they have with the guy in the governor's mansion in Albany.

He tends IMHO to be somewhat of a control freak, so Id  take a cue from what he's saying about racing. And, if folks don't care for that, they'd have to sway his opinion. Not an easy thing to do.

Personally, I won't bet Yonkers unless they go to Vernon. Saratoga racetrack, Tioga, Buffalo also don't interest me but I'd like to see them get going without fans (as if there were any) just to help the horsepeople out. Belmont and Saratoga flats i'd bet.
