THE JUDGE HAS THE FIRST AND FINAL SAY SO THROUGHOUT THE CASE AND FINAL SENTENCING.

IF CONVICTED VIA TRIAL--- OR PLEA--THE MINIMUN SENTENCE IS "ONE YEAR" WHICH EQUATES TO 85% OR 310 DAYS UNLESS YOU ARE OVER 60 AND THEN THE MINIMUN TIME SERVED IS 219 DAYS ON A ONE YEAR AND A DAY SENTENCE.

IN FACT ---IF SENTENCED TO ONE YEAR---YOU WILL SERVE MORE TIME THAN IF YOU WERE SENTENCED TO ONE YEAR AND A DAY.   UNDER THE SENTENCING GUIDLINES IT IS ADVANTAGEOUS TO BE SENTENCED TO ONE YEAR AND A DAY.

I AM NOT AWARE OF THE AGES OF THE CHARGED BUT IF UNDER 60 THEY WILL SERVE 85% OF THEIR SENTENCING IN A FEDERAL PRISON CAMP IF PLEA OF GUILTY OR IF FOUND GUILTY.
