They will appeal and Howie will strike a deal and they'll be lucky to get a dime! Unless there's a way for garnishment this case is over and done. They'll hide all assets and move on.
Garnishment? Wouldn't that require some kind of actual court order/judgement? Not the USTA clown court.
Exactly. Thats why they'll never see a cent. I don't know if the USTA can get a court order for garnishment or not. Another question for HT!
They could make the fine a Dr. Evil one billion kajillion gazillion dollars and makes no difference. Plus aren't these open ended detrimental to harness racing revocations? So what leverage do they have except for saying if not paid you can't get your membership back. And exactly how would a 501c6 account for these funds? Who are the victims???
Yeah. I'm not too sure on the legality..But something in the realm of obtaining financial gain through false pretense or fraud? I'm not a lawyer and don't know the laws concerning this fiasco.
The USTA and SRIF or whatever they want to call themselves have ZERO power to collect much less levy anything against anyone. This isn't a financial responsibility case like not paying fines where they can suspend your membership and stop you in your tracks. Only one I see that will work is the Stacy woman who got the $5000, if she doesn't pay they can squeeze her.
