Claiming Rules?

So Ken Koch claimed one on behalf of Tom Milici today at Monticello yet Ken was handed a 60 day suspension on Monday that takes effect on Friday.  Why would the track accept a claim from a trainer about to be under suspension?

On April 9  2025  the New York Drug Testing and Research Program reported to the New York State Gaming Commission that sample CV3583314  obtained pre-race  from the horse VINOVIO  1st place finisher in race 2 on April 1  2025  at Monticello Raceway  revealed a TCO2 level of 43.5+/-1.4 mm/l which exceeds the permitted limit for a horse racing on Furosemide.  On April 14  2025  Trainer Ken Koch appeared before a representative of the NYSGC. After consideration it is determined Ken Koch  as trainer of VINOVIO on April 1  2025  is in violation of NYSGC rule 4120.2; 4120.4; and 4120.13(a). Pursuant to NYSGC rule 4120.13(d)(1)  Trainer Ken Koch is hereby issued a full suspension of their occupational license for a period of 60 days (April 18  2025 through June 16  2025 inclusive) and fined the sum of $1 000.00. During the term of this suspension trainer Ken Koch is denied access to all course and grounds under the jurisdiction of the New York State Gaming Commission. Further  pursuant NYSGC rules 4120.5 and 4120.14(a)  VINOVIO is declared disqualified from said race and all purse earnings shall be returned and redistributed to appropriate finishers and VINOVIO must re-test at a permissible  TCO2 level prior to being declared eligible to race. VINOVIO too  shall be subject to 6-hour pre-race detention for the period of 6 months  4/14/2025 through 10/11/2025 without regard to whether the horse is transferred to a new owner or trainer. Any owner or trainer transfers of horses trained by Ken Koch  shall be subject to approval of the Presiding Judge at Monticello Raceway.

I've never heard of anything in the rules/regulations about claiming a horse when about to go out on a suspension. He claims, he has the horse, X days later he serves his suspension, then he comes back. Why should he be precluded from claiming a horse prior to the suspension?

   A track has to accept a claim from someone not currently suspended.   Duuuuhh  ngc3

His suspension doesn’t go in to affect til Friday. So he can claim horses right up till Thursday, but the horse will be suspended with him because claim rules are horse can’t change trainers for 60 days. All around dumb move
