East Rutherford, NJ – NOVEMBER 2, 2023
The United States District Court for the Southern District of New York, the Hon. Mary Kay Vyskocil,
has entered Orders of Conviction for Seth Fishman and Lisas Gianelli each having been charged
as Defendants in the matter of United States v. Navarro, Docket No. 1:20-cr-00160-MKV– SDNY.
Damian Williams, the United States Attorney for the Southern District of New York ,who
prosecuted these cases, announced at the time that Seth Fishman DVM received a sentence of 11
years in prison for his role at the helm of an approximately twenty-year scheme to manufacture,
market, and sell to racehorse trainers and others in the racehorse industry “untestable”
performance enhancing drugs for use in professional horseracing . Williams further announced
that Lisa Giannelli received a sentence of 42 months for her role in that scheme as she was
charged and prosecuted by his office arising from his Office’s multi-year investigation of the

Among the volumes of evidence introduced by the US Attorney in the prosecution of these
cases are trial exhibits, offered in open court and now available to the public, which reveal the
identity of numerous persons who have purchased prohibited substances - BB3(EPO) or TB-7
Thymosyn(sp). Persons identified in the lists below and categorized under those substances,
are referenced in those trial exhibits released by the US Attorney SDNY office to the
Meadowlands at its request.
Also, as part of its investigation, the Federal government conducted its own collection of blood
and urine samples from racehorses, both post-race and from out of competition testing. Below
is a list under the category, Drug Positives Federal Investigation, identifying trainers whose horses
tested positive in those tests.
This remains a serious matter. Consequently, the Meadowlands is conducting its own internal
investigation given these revelations. And until that investigation is completed, the
Meadowlands has determined that all individuals listed below will be placed on the
Meadowlands exclusion list. Furthermore, to avoid any appearance of conflict or impropriety
regarding a horse’s eligible to stakes during the month of November in which horses owned by
Jeff Gural may race, the above exclusion will be effective as of December 1, 2023.
We believe this time frame will also allow owners, should they choose, an opportunity to change
trainers and/or horses in partnership with excluded owners. We anticipate the Meadowlands
investigation will be time consuming. We also expect that additional disclosures will be released, and if
so, where warranted, the Meadowlands will act on that information. We will also require that any change of
trainers or dissolution of any partnerships with excluded owners will require proof to the
satisfaction of The Meadowlands. We believe these steps are warranted per the revelations
from the above prosecutions and are necessary in the interest of the industry we all love and
wish to preserve.

The list I saw had redacted addresses and products sold. I am sure the feds shared the unredacted list with Gural, hence the immediate exclusions. It seems they are going after the people who purchased Thymosin and EPO. However, I don't know what you mean by legit products. I can tell you any drug purchased without a required prescription is against the law.

Now you know why the harness criminals are fighting against HISA being enacted, as there would be no doubt about an EPO positive. If you get one, HISA rules would revoke your license and maybe indict you for a controlled dangerous substance. As it stands now, most will probably wiggle their way into racing in another state.

What you all are not realizing is that these people will not be racing in about two days. Forget about Jeffy and his track rule. If NJ Commission revokes those licenses there done right then and there. Also, after NJ Commission suspends them other states will follow right behind just like they did with the indictments. All those people were revoked two days after they were indicted. Every state in the land revoked all there licenses. Watch them all scramble now!

What you seem to not understand is the Feds are involved and not the various piece of shit state gaming and racing commissions. The Feds don't sweep shit under the rug like they do unless it will enhance their case. If I was on the list, I would be scared.

I don't know if the NJRC is going to get involved or take any action. These names are being "excluded" by a track "owner," not having their license "revoked" by a governing body (not yet). I do know Gural has been conducting his own investigations for quite some time now. No secret. He's using public information and information his people have turned up on their own. Don't forget Gural not only cooperated, but prompted and aided the Federal investigations that brought all those indictments, charges, and convictions.

I hope you are right but is this not the remnants of the original prosecution and that these people may not necessarily get charged. I thought I remember Gural being a little miffed that more people should have gone down at the time and that it would take up too many resources from the Feds to keep going. This list was built on the original case.

Feed and jog a horse daily between races and that is all that should be done, plus equipment adjustments, shoeing, etc. The smaller trainers should benefit from this and the same big owners keep using the same drugging crooks to win purses on horses in times that are inflated due to the drugs they jab into their necks and bodies. It is time to level the playing field and give everyone a shot at winning. The breeders know who the crooks are as well but revel in their misdeeds as they fraudulently inflate the stud fees on drugged up so-called champions. Trainers have no legal business injecting a horse and it should result in an automatic expulsion from the sport.

Harness racing was such a small part of gambling that it skated by with the usual assortment of crooks and lowlifes. Monied owners looked the other way as long as they were winning. The vast majority of little owners either love it or a financially stupid as they lose money on horses. Horse racing, both thoroughbred and harness are getting a closer look. These crooks are no better than Sam Bankman-Friedman, just on a smaller scale. How do you expect to grow a harness business when everything you read is it’s crooked. Gural owns a business and like any business can exclude whoever he wants. State legislatures may lower or take away the golden goose of subsidies in the near future. Don Nance was right “ it’s a dead game laddies”. For all the crooks who get caught and pay the price……who cares. I got out of the game years ago, don’t bet or follow it other than reading here.
