Excessive or indiscriminate use of whip

Additional Details:
Rule 4117.8(D)(2) & 4117.8(H)(2) Driver Greg Merton is hereby assessed a fine of $500.00 and suspended from driving for 7days, April 23, 2026, through and including April 29, 2026, for use of the whip in an excessive manner; using the whip more than three times in succession without giving the horse time to respond while driving FULL DISCLOSURE in the 8th race on April 22, 2026, at Monticello Raceway. (This violation constitutes a 3rd violation in this category in a 365-day period.) Further violations in this category will result in increased penalties.
