I find it extremely hard to believe that he got a years probation and a big fine just bc of that drive, unless the judges have more than just that. Ive sat behind 4/5 shots that for one reason or another had absolutely no interest in racing that night. So you have a choice of staying on the rail and look like you're cheating or pulling and going backward causing danger for everyone behind you. Most guys will opt to just stay out of the way and live to race another day. You learn to tune out the "hey you asshole cheater" comments from those who can't even spell horse, let alone drive one

FirstUp  ...   I agree with your comment, but it doesn't fit this race.  Watch McNair's horse down the stretch.  It was wanting to climb over horses, but there wasn't a hole available.  I still believe the race was lost when Henry backed up into his face between the half and 3/4 pole.
You could also argue, he has so much the better horse, why wasn't he out first over and he wouldn't have had to worry about anybody else, but sometimes you go into a race wanting the easier trip with cover, expecting to win and take less out of the horse.

This is a BS fine and suspension.

Ask Ben Wallace what he thinks. There is no way McNair is stiffing one of Ben's horses is the damn preferred at Mohawk. That's just stupid. You are not stiffing that trainer in that race, no matter what you think of McNair.

McNair thought the 5 was the best or the next best. So did the betting public. He floated out of there expecting to be towed to the top of the lane by the 5 and blow by him. The 5 came up empty and shit happened.

If he could do it again of course he tips earlier, but he believed like everyone else it was a two horse race so he was going to win and have a good trip.

It didn't work out - that's different than cheating!

McNair locked Cullen in earlier in the card & Cullen in turn returned the favor...

The fine and suspension is for beating Cullen in the event.

This should have never been given this paltry a fine & suspension. Keith Oliver got six months for crowning Randy Waples (deservedly so) 17 years ago.

McNair should have got a six month suspension & 25k fine minimum for these actions. If Cullen had done the same thing, he would have been barred for life, guaranteed. tmbz1
