You can claim a scratched horse.  They have 24hrs to bring horse to track for you to inspect and they have option to take horse.  I know because it happened to me.
They ain’t letting you INSPECT the horse before you decide to claim. If you tell the judges you want to claim the scratched horse and they call the trainer and tell him to bring the horse to the track, he’s your horse. Ain’t no inspecting just as if you were claiming him at the track in the evening.
