BREAKING🚨 A federal judge just BLOCKED Trump from throwing out 20,000 California ballots one week before the midterms—after Trump’s attorney admitted their list of voters “was purchased.” It gets worse…
In a scathing rebuke, the 9th Circuit’s majority wrote that the government’s “claimed emergency, at least in part, is a self-constructed one.”
One of the two judges who ruled against the administration, Mark Bennett, was appointed by Trump. He wrote that even if the court could reach the merits, he would still deny the request, warning it risked “the disenfranchisemen t of eligible voters” and put “the entire tabulation process in jeopardy.”
The DOJ had sued California and Los Angeles County on October 15, demanding they set aside ballots from voters it labeled “likely” noncitizens until their citizenship could be verified. Mail ballots had already gone out to every registered voter two weeks earlier.
Election officials had been given just 48 hours to review the list. When trial judge David Carter didn’t rule by a noon deadline the DOJ set for him, the department treated his lack of a ruling as a denial and rushed to the appeals court.
At a rare Sunday emergency hearing, DOJ attorney Matthew Donnelly struggled to explain what role an unnamed third party played in flagging voters.
He said the government had been “supplied a list that was purchased.”
California’s lawyer called the data “wildly outdated.” When Los Angeles County reviewed 200 names on the list, 112 had inactive or canceled registrations. Among those with usable birthplace information, nearly 4 in 10 were born in the United States.
Trump has claimed without evidence that more than 190,000 noncitizens are registered to vote in California. His administration has charged 28 people in the state with voter-registration or voting-related crimes.
California law already requires every voter to swear under penalty of perjury that they are a citizen.
“Trump is illegally trying to seize powers in the Constitution entrusted to others so he can stay in power,” Gov. Gavin Newsom said.
