NEW YORK STATE GAMING COMMISSION IN THE MATTER OF JAMES P. McNEIGHT SR NOTICE OF SUMMARY SUSPENSION AND HEARING MO 13-2025 To: JAMES P. McNEIGHT SR PLEASE TAKE NOTICE that the valid receipt of James P. McNeight Sr (Respondent) that permits Respondent to participate in pari-mutuel racing as a Trainer is hereby SUSPENDED IMMEDIATELY pending the disposition by the New York State Gaming Commission (Commission) of the scheduled hearing before the Commission or if Respondent refuses such hearing or defaults in appearing then such valid receipt and all rights to participate in harness racing in New York are SUSPENDED until such time as the Commission in its discretion takes further action including but not limited to denial of Respondents license application and withdrawal of such valid receipt. A hearing on this matter will be held at 9:00 a.m. on Friday May 9 2025. PLEASE TAKE NOTICE that this action is taken pursuant to Racing Pari-Mutuel Wagering and Breeding Law (Racing Law) 309 310 and 321 9 NYCRR 4119.7(a)(5); 4119.7(b) 4119.8 4119.9(a) and 4120.6(a)(1) and State Administrative Procedure Act 401 upon a finding of the Commission that the public health safety and welfare imperatively requires this emergency action because Respondents conduct related to the possession and use of a hypodermic needle and syringe to inject a substance into an equine athlete at Buffalo Raceway was so egregious that (1) such conduct calls into question Respondents ability to properly care for horses for which Respondent is responsible pursuant to the valid receipt held with the Commission (2) Respondents actions and continued participation in racing are potential dangers to the public health safety and welfare including that of equine athletes (3) Respondents actions are inconsistent with the experience character or general fitness required for participation by Respondent in harness racing or related activities; and (4) Respondents continued participation in pari-mutuel racing is presently inconsistent with the public interest convenience or necessity and/or is inconsistent with the best interests of racing generally based upon these circumstances and charges: 1. On or about May 1 2025 Respondent was observed possessing a hypodermic needle and syringe on the grounds of Buffalo Raceway; 2. On or about May 1 2025 Respondent was observed using a hypodermic needle and syringe to inject a substance into the horse Herecomesdasherif f on the grounds of Buffalo Raceway; 3. Respondent is neither a Commission veterinarian a track veterinarian or a practicing veterinarian or veterinary technician licensed by the Commission and therefore is not permitted to have or possess in or upon the premises of a licensed harness race track any equipment that may be used for hypodermic injection or other infusion into a horse or any vial bottle or cartridge designed and usable for such purposes pursuant to 9 NYCRR 4120.6(a); 4. The foregoing misconduct demonstrates that Respondents continued participation in pari-mutuel racing is presently inconsistent with the public interest convenience or necessity and is inconsistent with the best interests of racing generally pursuant to Racing Law 309(2); and 5. The refusal of Respondents license application and suspension and/or revocation of Respondents valid receipt and all rights to participate in harness racing in New York are necessary to protect the public health safety and welfare. PLEASE TAKE NOTICE that Respondent may be represented by counsel cross examine witnesses and present evidence and arguments on Respondents own behalf. Interpreter services will be made available to deaf persons and people who are not English language proficient at no charge but should be requested in writing at least one week before the hearing date. Respondent is responsible to deliver this Notice of Hearing to Respondents attorney if Respondent has or retains one. This hearing shall be a de novo hearing that may result in the imposition of any legally available penalty including a license refusal and/or suspension or revocation of Respondents valid receipt; Respondents exclusion from all racetracks in New York State whether as a holder of a valid receipt a licensee participant or patron; and a fine not to exceed $25 000 for each violation pursuant to Racing Law 116. PLEASE TAKE NOTICE the Commission typically conducts hearings by videoconference. Under this procedure the hearing officer may preside by videoconference. Please note Respondent must contact the Commission to arrange for Respondent including Respondents attorney and witnesses to videoconference from Respondents own location(s). To participate in Respondents hearing by videoconferencing from Respondents own physical location Respondent must at least three days before the scheduled hearing date telephone the Commission at (518) 388-3706 to establish Respondents videoconference location(s) and to verify that Respondent will appear on Respondents scheduled hearing date. To participate in Respondents hearing in person rather than by videoconference Respondent (or Respondents counsel if any) must telephone the Commission at (518) 388-3706 at least three days before the scheduled hearing date to arrange for Respondent Respondents counsel or any of Respondents witnesses to appear in person at the Commissions headquarters located at 354 Broadway Schenectady New York. PLEASE TAKE NOTICE that the Commission requests that if Respondent wishes to use mark or introduce demonstrative evidence (e.g. documents) at the hearing then Respondent must provide a copy of such evidence in advance of the hearing date to the Commissions assigned counsel and the hearing officer. Any demonstrative evidence not possessed by all parties and the hearing officer at the time of the hearing may be barred from use. PLEASE TAKE NOTICE that the hearing may be adjourned at the discretion of the hearing officer for good cause shown upon the request of any party. Requests for adjournments must be submitted at least two business days before the date of the scheduled hearing. Absent a serious emergency matter no requests for adjournments will be granted within two business days of the scheduled hearing date. To request an adjournment Respondent must contact the hearing officer William Chen at bill@lo-wchen.com with concurrent notice to the Commission's assigned counsel Jessica Desany at jessica.desany@gaming.ny.gov as soon as possible. After the opposing party has had the opportunity to be heard regarding the request for adjournment such request must be approved by the hearing officer to take effect. If Respondent fails to appear at the hearing without an approved adjournment Respondent will be in default the Commission may proceed in Respondent's absence with the hearing and Respondent's appeal or request for a hearing may be deemed withdrawn. How stupid are these guys. There are 100 places within a mile of the racetrack to inject. To get caught at the racetrack is really a new level of stupid. You just can't fix stupid.

I have seen it for myself.
