A friend of mine bought one off Ongait last year. Paid over 20k for him. Greg McNair had him listed looked like a nice 3 year old colt. Didn’t even get to race him due to a torn suspensory before he arrived.

As a White House press spokesperson, I am urging all horsemen to boycott ongait until they do something to fix the problem of screwing over unsuspecting buyers for the past three years. Erv and Virgil get a percentage of every horse sold on ongait because Eric Cherri runs the bid up and then kicks them back money at the end of the auction. It’s all a scam so it’s not any longer buyer beware, this is outright criminal fraud and they are going to get prosecuted. I urge any horsemen who ongait has screwed over to at least report it to the Florida office of the attorney general. If you need their contact information, send me PM and I’ll give you my contact person. Maurice and Eric need to be shut down just like I got the investigation started with cash app and mesothelioma. They are not too big to take down. We just have to get them reported to the right government agency. Eric P

I got screwed on On Gait by Erv Miller. He posted a trotter (Ponda Adventure ) on December 1st using the same pictures that he used in January at another sale. The horse had a knot on the back of his knee the size of a peanut butter cup, bloody and festering. This was a total misrepresentation, and the horse has been off with a coffin bone problem since the first of the year. I could easily have taken Erv to court and would have won the case but it would have been very expensive and time consuming. I decided instead to let everyone know that they should be very careful when buying a horse from Erv Miller. I will continue to advise people when he posts horses on On Gait. If we all outed the liars and cheaters, they couldn't sell their horses. On Gait can't stop these people from lying but we can if we call them out every time some one misrepresents. Harness Racing is fun!

Speaking of Miller he has two on On Gait this Saturday. I would advise anyone interested to do a thorough vetting and sit behind the horse before buying. Also verify that the horses pictures are actually the horse being sold. I suspect that the end purchaser will end up screwed/ Lots of horror stories out there about Millers integrity when it comes to selling horses.

The company simply provides a sales platform, where sellers can list or list for auction, and people can bid or buy. Pretty simple concept. The site is no different than any public auction, either virtual or in person auction. The people that auction or list horses on the site are the same people that sell at Blooded Horse, Harrisburg, etc, or online at PEO. You want Ongait to not take listings because you question the quality of the horse? Well if this happened there would be zero auctions, live or virtual. Auctions are and always will be buyer beware. If you question the seller, it literally couldn’t be more simple, don’t bid on that horse. A lot of the comments on this thread show you either don’t understand the concept of auctions, or sales in general. You people are saying you’ll buy a horse, from a seller, without inspecting the horse, thru a website that just provides a platform, and you want to blame the website for it? No idea where this logic comes from, for the love of humanity please tell me you’re smarter than that.

If you were you would understand there aren’t “run up bids” or “kickbacks”. There is a large group of shareholders, all horsemen in the industry. As a shareholder you pay normal fees and commission just like everyone else does, and there isn’t any special way to see who is bidding and run up. Ever been to a live auction? Because the auctioneers and bid spotters never run people up, right? Maybe everyone at Lexington should file a complaint with the attorney general ngc3 Very disappointing from you Eric, as someone that I see normally just report facts, really thought you were more than that.

What’s odd about this? Guess you’re a fan of people getting robbed. This is not like Harrisburg. This is full of cheats and scams. And at public auctions you can see the horse live, not photos from who knows when. Nice of you to come on here and defend assholes. You must be Per Engblom’s gopher.

Here is another gentleman that bought a mare off On Gait that got fucked. If you go to the group Anything Harness Racing For Sale on Facebook, Leo Marino has 3 different post about the mare Tall Poppy N mare he bought off OnGait who was lame (left foot screwed together) looking for some advice and guidance on how to proceed. Tall Poppy N- purchased this horse to race. She was listed on ongait.com as a horse with 4 clean legs and ready to drop in the box. She raced as recent as 9-11-24. Purchased her shortly after. When I reached out to the trainer she simply said to me "trains great doesn't race great needs a cheaper track". She was very nice describing the horses personality and gave me the idea I'd be ok buying as a racehorse. Provided the blood records, everything looked good.
We drop her in the box just like the description states but we discover she's foot sore, we gotta scratch. Vet comes in and discovers she has the left front foot screwed together. Vet recommends nerving which would run around $2,000 followed by 30-40 days off. Unfortunately for me ongait doesn't have insurance for these situations so she's available for sale. With her breeding and iron toughness on the track she's a lock to spit out some good ones, given the proper time she'll even come back to the track and recapture the brilliant speed she's shown in her career.
I ain't looking to blast the old trainer, mistakes happen horses go in and out of barns but these are the facts. Horse hasn't been raced since purchased and the X-Rays taken can indicate why.
Let's get her situated somewhere and to someone who could appreciate being around this beautiful animal. Make a good solid offer and she'll be on her way to you.

Tall Poppy N- after weeks of trying to contact the seller Rodney Long, Ongait has offered some advice to me. Just stop paying the bills on her and take the Amish offer. Also I was told that if I ever wanted to bid on a horse “like that” I should call and get his opinion. Was asked for a second time and I quote…”what reason would you have to bid on a horse beaten 45 lengths”? This is a man who owns 300 horses in our business. He admits to the fact I got screwed but there will be no refunds given. He also said he will continue to try and contact Rodney. He is banned from the site and that’s the best he can do. He also asked in the event I contact Rodney would I accept half my money back? Clearly that’s not an option considering he’s 100% at fault.
I basically had to initiate every inquiry about the situation with Ongait, Tessa (who went silent after I was wise to the situation but perfect prior) and of course Rodney “I can’t talk right now but I can see your text messages” Long. Horse was blocked sound (vet reports prove that). Advertised on their website incorrectly but it’s me who has to accept responsibility.
I’ve been an owner in this business since 2016. Bought and sold many horses on his website and always conducted myself properly.
Tall Poppy N is available, breeding season is upon us. Let’s do the right thing and get her situated. With her breeding I can’t see why she won’t make someone a happy mate.
This is not a personal attack on anyone this is just the way it went down. There’s a lame horse sitting in a stall in Saratoga, it would be nice if Ongait took responsibility and stepped up. Rodney Long you can make things easy and put this to bed with payment. Anyone who drive’s a horse for you should know the respect you have for them and the horses you own.

Tall Poppy N was sold to me as a racehorse described as 4 clean legs sound and ready to drop in the box. Unfortunately, after walking lame a few days after she arrived it was discovered she was blocked sound by the previous owner or trainer that sold me the horse. I made many numerous attempts to contact the old owner to do the right thing and take her back. He took the route of ignoring my calls, texts and proof of the counterfeit sale.
She had a screw placed in her left front foot which is shown in the pictures provided. I think she'll have an amazing career as a broodmare. She's got great size, her record and breeding speak for itself. Vet advises nerving and 30-40 stall rest. If you wait on her she could probably be a useful racehorse but I'm selling her for the reasons above. Currently she's located on a farm 15 minutes from Saratoga, NY. Personally, if I had the resources to stick it out with her I would but clearly, I don't. Feel free to contact me if you have questions or concerns.

I have bought cars, property, airplanes and horses on line including a home in FLA. I have learned one thing in my 81 years and that is if you deal with assholes you will come out smelling like shit.
The character of the seller is most important to me and you will note that most of my horses have been bought from pretty good people.
Some people think that the woman carrying the purse is at fault not the purse snatcher. Go Figure!

Lots of different experiences I’m sure. Me personally I’ve done extremely well on the ones I’ve bought off the site, but I do the homework. I either know the seller/trainer or I have someone look. But if I bought one and it turned out to have an issue, I would discuss with the seller who perhaps wasn’t truthful, I can’t imagine being so stupid as to try and blame the website where the seller listed the horse. That’s comparable to buying a used car from a newspaper classified ad and being mad at the newspaper company if the car ends up having an issue.

Why not charge a simple superficial $150 accredited vet check examination fee before listing is accepted to the seller,, so that way (buyer, seller, consignor and auction Co.) reputations are protected from fraudulent activity..

If I'm interested in buying a horse online, I wouldn't take somebody's word for it about the horse, I would do my homework. Someone from a higher authority should ban them from the site, or there needs to be a certain time frame you can void the sale if the horse only has 3 legs.

I don't love the people at ongait but what are they suing for? They are a horse marketplace who implicitly say they do not guarantee anything. Am I missing something. it is total buyer beware.

If someone is selling a horse and using old pictures, or whatever fraud they are committing, if Eric in unaware, he's protected. If Eric is aware, and involved, prove it...and as much as I'd like to see that...good luck with that.
I bought one horse off ongait. I didn't want to, but I did, LOL. I sent a trainer, he sat behind the horse, and we had him fully vetted, x-rays, full blood, etc., and all. I got the horse at my price. I did everything I could possibly do for my due diligence. Buyer beware.

If someone is selling a horse and using old pictures, or whatever fraud they are committing, if Eric in unaware, he's protected. If Eric is aware, and involved, prove it...and as much as I'd like to see that...good luck with that.
I bought one horse off ongait. I didn't want to, but I did, LOL. I sent a trainer, he sat behind the horse, and we had him fully vetted, x-rays, full blood, etc., and all. I got the horse at my price. I did everything I could possibly do for my due diligence. Buyer beware.

Go read the contract and know who you can sue and who you can't. Nobody has to do business with them. If you choose to, you are signing their contract. Period. Your choice. Is it fair? No. But you are making the decision.

And, with the contract language...I think a buyer who falls victim to fraud, would have a lot higher success suing the seller, than they would Eric Cherry. However, unfortunately, at the end of the day every seller, every auction and sales company has the same absolute protection...cave at emptor. Fraud opens the door, so let someone go through it. While it was a private sale, I am sure Pollock explored every possible option with Funtime Bayama.

I understand that Ongait isn’t responsible for the seller listing a broken down horse in their auction and lying, but for Christ sakes at least ban them from ever doing it again. Erv has done it to multiple people. It’s just not cool to keep allowing their sellers to commit fraud and them claim buyer beware. Come on now.

Are you truly being that simplistic, or just not reading. I did not compare the two. I gave an example. Go get the sales agreement from ongait---the actual contract---and you will see very similar language; difference being state-specific vis a vis contract law. I'll try to make this very simplistic, and I'll type slower if that helps---your recourse against both sales/auction companies, any sales/auction company, is simply extremely limited to none. Is it fair? No. But if YOU made the decision to sign a unilateral contract, then caveat emptor. You bear the consequences of your own decision. Recourse against Erv---sure, you can try. Go right ahead. Go lobby ongait to ban Erv. Go make your case that Erv was guilty of fraud. Go do whatever you want. He's a crook. It's not fair. It's wrong. In the end, you chose to do business with him. Plenty of people have done business with ongait and did not get screwed. I don't like it, nor Eric, but that's the truth.
