UNSATISFACTORY DRIVE - CARELESSNESS
An administrative hearing was conducted on January 18, 2024 to accept evidence and testimony relating to a racing incident which Kubi Erzene was involved in during the 3rd race on Friday, January 12, 2024 at Freehold Raceway. As a result of the administrative hearing, the Board of Judges have determined that: New Jersey Racing Commission ("NJRC") licensee, Kubi Erzene was the driver of the horse "Miss Bombsaway" when it competed in the 3rd race at Freehold Raceway on Friday, January 12, 2024; During the stretch drive of the 3rd race, Mr. Erzene did fail to drive his horse, "Miss Bombsaway," to the finish line of the race, therefore failing to take full advantage of racing opportunities in the stretch. Not only did Mr. Erzene fail to drive his horse to the finish, he "grabbed up" just before the finish costing his horse a winning performance. Whether this action was intentional or due to gross carelessness, it affected the outcome of the race in the most egregious manner and negatively impacted those patrons who wagered on the horse. Mr.
Erzene failed to conduct himself in a forthright and professional manner. Mr. Erzene's actions constitute conduct detrimental to the sport that undermined the integrity of racing and the pari-mutuel wagering thereupon. Mr. Erzene is in violation of N.J.A.C. 13:71-7.29(a)13 - Conduct detrimental to the sport N.J.A.C. 13:71-20.10(a), (b) Fradulent or unsatisfactory drive Having considered the severity of the incident on Friday, January 12, 2024, Mr. Erzene is hereby issued a suspension of his NJRC driving license for a period of one year (365 days). The said suspension shall begin on Friday, February 16, 2024 through and including Saturday, February 15, 2025.

This kid completely exposed himself in this race as he can usually be seen whipping and bouncing throughout entire miles. In the race in question, he took a monster hold straight back in the bike that would make Allan Davis look like a rookie stiffer. The kid is dangerous on the track and gets zero respect. He now should be in jail for race fixing.

He has #3 in race 8 at Freehold today. He will be driving and actually has a shot.

I don’t know what kind of horse Kube was driving, but that was close to a non-effort.

Kubi trains owns and drives #8 in race 2 at the Big M tonight.

If anything he might be forced to make a driver change but a scratch seems unnecessary.
