  John Moody, et al. v. Michigan Gaming Control Board, et al.;  6th Cir. No. 16-2244/2369; Supreme Court No. 17-1142  The Supreme Court Rejected The Michigan Gaming Control Board’s Appeal In The Long-Running Harness Racing Drivers’ Case.  On June 18, 2018, the United States Supreme Court denied the Michigan Gaming Control Board’s (MGCB) attempt to appeal their loss in the Federal Sixth Circuit Court of Appeals in the long-running case involving four Michigan harness racing drivers.  This is the second time the MGCB has attempted to appeal to the Supreme Court.  The case will now be returned to the United States Eastern District of Michigan for trial.   The case began in 2009, when an anonymous tip claimed that certain individuals were consorting with gamblers and fixing harness races.  A review of the tapes of the races revealed nothing.  (Neither did a claimed investigation by the Michigan State Police.  In fact, it turned out that the case number provided  by the MSP did not exist.)  The mystery of this phantom investigation has yet to be solved.   Regardless, in May 2010,  the four plaintiffs, John Moody, Donald Harmon, Wally McIllmurray, Jr. and Richard Ray were threatened with arrest and called before a Racing Steward’s hearing.  They asserted their rights under the Fifth Amendment on advice of counsel because of the threats.  Their licenses were summarily suspended and they were not even allowed  to submit applications the following year, preventing them from
2  seeking an administrative appeal.  They sued in 2012, but did not have their licenses restored until May 2014, thus missing four years of work.   Plus, in harness racing, a suspension in any state automatically leads to suspension in every state.  Further, adverse actions were taken against members of their families involved in racing in the United States and Canada and  the MGCB claimed that they were not even allowed to train either their own or customers horses on their farms.  They suffered devastating economic losses,  not to mention the national damage to their reputations.  The economic losses alone are in the millions of dollars. Now the MGCB can no longer avoid the consequences of their illegal actions. Moody, Harmon, Ray and McIllmurray are represented by Hugh (Buck) Davis and Cynthia Heenan of Constitutional Litigation Associates in Detroit, together with research specialist Scott Mackela.  Their attorneys were assisted in the case by Dennis Wolfe, a retired teacher with deep knowledge of due process, the Michigan Administrative Procedures Act and the Michigan Horseracing Rules, having been himself involved in harness racing.  Paul Hughes of Mayer Brown in Washington, DC, filed the Response in Opposition to the Supreme Court Petition by the MGCB. Wages alone total well into the millions, haha. These guys were broke then and broke now. Get the fuck outta here with lost wages in the millions.  Getting suspended was the best thing for them because it gave them a chance to get off welfare and make a living in the real world.

These guys were caught fixing races, and now they get paid for it?  Their rights were violated, how about the gamblers rights when these guys stiffed?  Another good reason to turn out the lights and put harness racing to bed. Permanently  11.gn

  Didn't  Rayleturd get fired from the Free Press for putting phony picks in the paper so he and his crooked friends could cash tickets that would pay a little more cause the Rayleturd didn't pick the horses in his top three.  and I heard he would pick a horse to win, fully knowing that the horse was going to be dead thus robbing the betting public.
     There are a couple of more 'fixers' who didn't go along with this law suit and they haven't kept quiet as to what really was going on.

  We all payed our price and it is good to once again know, Crime does indeed pay in Michigan Harness racing.

WHEN LOUIE DIED, FORD MOTOR COMPANY LOST ONE OF ITS BOOKIES, AND HARMON, PLUTA AND TERRY BUTER STARTED BREATHING A LITTLE EASIER.  AS FOR THE JEWELER, BATESON AND RIDEOUT GOT A GET OUT OF JAIL FREE CARD.    THESE DRIVERS LOST SO MUCH MONEY BETTING FOOTBALL, THAT THEY OWED A FORTUNE TO THE BOOKIES AND TOSSED A FEW TO SETTLE THE BETTING BILL.
