Horse sold in auction before he races

I see where a horse was into go at Rosecroft tonight that sold a few days ago at Ongait.com and past scratch time. And he shows scratch "sick" in tonight's charts. I thought that was not allowed. Isn't that failure to honor a declaration fine?

Looks like a clear cut case of Failure to honor declaration to me.
