Hey Rocco....Care to comment on why Miller used pictures that were 1 year old or did you just happen to overlook that statement. I understand buyer beware but posting pictures that are not of the actual horse seems like anyone who does that knows exactly what they are doing. If that can be proven the seller should be banned and all monies refunded not to mention that Ongait should put a post explaining what happened. This is the right thing to do but then again we are talking about $$$$$ where right is usually wrong

If it can be proven that he was using old pictures you should sue him not the online platform

I AGREE WITH YOU ON THIS. I WOULDN'T SO MUCH AS HOLD ONGAIT RESPONSIBLE AS I WOULD ERV MILLER.  HOWEVER IF THERE IS EVEN A HINT OG MISREPRESENTATION AT ALL, THEN ONGAIT SHOULD HELP THE BUYER IF THEY DECIDE TO FILE A LAWSUIT AND MAKE AN EXAMPLE OUT OF ERV. I WOULD ALSO GO ON EVERY PLATFORM AND TALK TO EVERY HORSEMAN THAT I POSSIBLY COULD EVEN THE USTA AND SHOW EXACTLY WHAT ERV MILLER DID. ITS GOING TO BE INTERESTING TO SEE IF ONGAIT OFFERS ANY HELP AT ALL TO THE BUYER AND BARS ERV MILLER FROM LISTING OR BUYING ANYTHING. I WONDER WHAT DOUG OVERHISER AND ROCCO RUFFALO THINK OF HONEST ERV MILLER NOW?

The only reason you sue is to line the pockets of the lawyers. Not sure what the horse costs but is someone really going to spend half or more to get the other half back. What should happen, but won't, is if the buyer can prove the pics are outdated Ongait should step in and do what L&O says. But Ongait has their money and will do nothing to help, in addition to the fact Miller is bigger than the buyer, which should not matter but it does

Just so you all know, some of the shareholders and/or members of On-Gait are Andy & Julie Miller,(for there kids) and there ally N Surick. The bought into it a few years back and will make sure that nothing happens here and they can continue to list horses for sale no matter what.  They take care of their own and fill their pockets without fear of consequences. HOW IN THE HELL CAN YOU DO THE DUE DILIGENCE WHEN A COCKSUCKER PUTS UP PICS OF THE WRONG HORSE. I MEAN COME ON. A BUYER CAN ONLY DO SO MUCH BUT PUTTING UP PICS OF A DIFFERENT HORSE AND REPRESENTING THE HORSE AS SOUND IS TOTAL BULLSHIT IN MY OPINION. THAT IS JUST PLAIN WRONG AND VERY EVIL. ONE DAY PRICKS LIKE THAT WILL GET THEIR DUE. IF HE DID THAT TO ME I PROMISE YOU I WOULDNT SAY ONE WORD BUT I WOULD WAIT FOR HIM OUTSIDE OF THE TRACK ONE NIGHT AND PUT A GUN RIGHT TO HIS TEMPLE AND TELL HIM IF I DIDNT HAVE MY MONEY BACK WITHIN 24 HOURS THE NEXT TIME I SEE HIM HE WONT LIVE.

IF THESE WERE PICTURES OF A HORSE THAT WERE TO BE CURRENT PHOTOS AND THEY WERE DTED BY A YEAR AND IF THE ANIMAL WAS STATED AS "SOUND" AND IF THE BUYER RELIED ON THESE PHOTOS AND PICTURES TO MAKE A PURCHASE THEN THIS IS IN FACT A FEDERAL OFFENSE.   I WOULD RECOMMEND CALLING THE FBI IN THE JURISDICTION WHERE THE BUYER LIVES AND THE TRANSACTION TOOK PLACE----REPORT ALL OF THE DETAILS OF SAID TRANSACTION TO THE FBI----THEY WILL DECIDE IF THERE IS ENOUGH EVIDENCE TO PURSUE AN INVESTIGATION INTO THIS ISSUE.   THIS DECISION COMES FAIRLY QUICKLY AS THEY WOULD MAKE PHONE CALLS AND DO EXTENSIVE DUE DILIGENCE IN A TIMEL FASHION.   IF THEY FIND THAT THERE IS SUFFIIENT EVIDENCE OF SUCH A CRIME---THEY WILL LAUNCH A FULL SCALE INVESTIGATION INTO THE MATTER AND POSSIBLE CHARGE THESE FOLKS.

I AM NOT SURE WHERE THE BUYER IS LOCATED BUT THAT WOULD BE THE FIRST PLACE TO CALL---THE LOCAL FBI OFFICE IN HIS STATE.

ADDITIONALLY, THE SOUTHERN DISTRICT OF NEW YORK HAS EXTENSIVE FILES ON MANY IN THE EQUINE INDUSTRY.   NOT SURE IF THIS FELLA WAS MENTIONED IN ANY OF THEIR DUE DILIGENCE BUT THE DA IN SOUTHERN DISTRICT COULD BE CONTACTED AS WELL AND THIS ISSUE COULD BE REPORTED.  NOT SURE WHERE THE SELLER OR BUYER IS FROM BUT IF THIS HORSE HAS RACED AT YONKERS OF NEW YORK THEY MAY BE ABLE TO TIE IN JURISDICTIONAL PROSECUTION IF IN FACT THIS HAS OCCURRED.

I TRUTHFULLY HAVE NO KNOWLEDGE OF ANY OF THIS EXCEPT THE STATEMENTS MADE AND THIS COULD BE AN AVENUE TO FOLLOW IF IN FACT ALL OF THIS OCCURRED.

ADDITIONALLY IF IN FACT SEVERAL OWNERS OF STOCK OF THE SALES COMPANY WERE IN FACT INDICTED AND CHARGED THE SOUTHERN DISTRICT SHOULD BE CONTACTED AND NOTIFIED IN ORDER TO HELP COLLECT THE MILLIONS IN RESTITUTION THAT THESE FOLKS FROM PRIOR CHARGES ARE OWED.   I WOULD GUESS IT IS POSSIBLE THAT THESE ASSETS WERE NOT DISCLOSED TO THE FEDS WHEN THEY WERE SENTENCED AND ARE CURRENTLY SERVING THEIR TIME.   IT IS POSSIBLE THEY WERE NOT DISCLOSED.   THIS HAS NOTHING TO DO WITH THE SALES COMPANY BUT THE FINANCIALS OF THE FOLKS INDICTED AND NOW SERVING TIME WITH RESTITUTION.
