Counselor, in an Ideal world your scenario may play out. In reality, after a guy maxes out on probation, he often will not pay another dime.
I have a couple problems with the judgments and fines. So, I understand the fines paid to the court go to the General US Government fund. Some may go direct to victim recovery programs. The money paid in restitution goes where? Many companies have already written of losses due to crime. In the cases of horse racing , who is named the receiver?
We have been told the formula used to arrive at these restitution figures include: horse owners, trainers and gamblers. Others , as well. So, where do I participate in my share of restitutions? I have been harmed as an owner and gambler. Where is mine?
We know this will never be distributed to these groups.
Back to the intent of the penalties. I am in no way defending or even slightly empathetic to these low life thieves. But, paying 10s of millions of dollars to a government is not realistic. Paying 10% off the top of my common labor's wage for 20 years, is not realistic. Getting a high paying job or position that would allow me to pay is not realistic.
It is more of a catalyst to continue looking for other ways to earn that does not include the government. Being locked up in an institution where everyone was a criminal will defiantly broaden your scope on how to score.
Does anyone think Chris Oaks or any of the others will stay at a wage earner's position and cough up 10% to the Feds for 20 years?

THE JUDGE WEIGHS OUT ACTUAL LOSSES AND SOMETIMES TOTAL LOSSES IN A CRIME. FURTHER, THESE JUDGMENTS CAN BE JOINT AND SEVERAL. THEREFORE, THIS JUDGMENT MAY BE LEVIED ON THE DEFENDANT AS WELL AS OTHER DEFENDANTS JOINT AND SEVERAL.
YOU ARE CORRECT AS MOST OF THESE ARE NOT COLLECTED IN FULL. FURTHER, IT IS POSSIBLE THAT PROBATION MAY BE DENIED BY THE PROBATION OFFICE AFTER THE RELEASE OF SAID CONVICT AND AFTER HE SERVES HIS PROBATION OF 3 YEARS. ADDITIONALLY, IF RESTITUTION IS OWED YOU WILL NEVER RECEIVE A TAX REFUND NOR WILL YOUR WIFE IF FILING JOINTLY. ALSO, YOUR PASSPORT MAY BE DENIED OR REVOKED WITH RESTITUTION IN EXCESS OF $50,000.
PLEASE UNDERSTAND THAT THE FEDERAL SYSTEM IS DIFFERENT. THE PROBATION OFFICE REQUIRES MONTHLY FINANCIALS AND ONCE PROBATION ENDS THE REMAINING BALANCE OF RESTITUTION BECOME S A CIVIL JUDGMENT. USUALLY IT IS HANDED OVER TO A THIRD PARTY DEBT COLLECTOR BUT OFTEN WITH LARGE SUMS THE US GOVERNMENT RETAINS JURISDICTION OVER THE JUDGMENT TO INSURE PAYMENTS ARE PAID. YES, THE GOVERNEMENT WILL NOT WALK AWAY ON THIS THE SENTENCING JUDGE AFTER A REFERAL FROM THE PROBATION OFFICE SETS THE MONTHLY PAYMENT TO THE COURT. WHILE INCARCERATED THE DEFENDANT MUST PAY PAYMENTS AS WELL AND THE MINUMIN PAYMENT WHILE IN PRISION IS $25 MONTHLY FROM YOU PRISION JOB.
THESE FOLKS WILL PAY A MINIMUN PAYMENT MONTHLY FOR THE NEXT 20 YEARS. ALL ASSETS ARE SUBJECT TO GARNISHMENT OR REPOSSESION. YOUR PENSION AND SOCIAL SECURITY CAN BE LEVIED ON AS WELL AS ANY INCOME FROM ANY JOB OR LOCATION NATIONWIDE.
VERY RARELY DOES THE JUDGMENT EVER GET PAID IN FULL PLUS RECALL MOST CRIMINAL JUDGMENT HAS CRIMINAL INTEREST RATES SUCH AS 6% AT THE LEAST. ^5 ON 40 MILLION CANNOT EVER BE PAID BY ANY HUMAN.
FOLKS, THESE JUDGMENTS WILL NEVER GO AWAY. THESE FOLKS WILL HAVE SOMEONE FROM THE FEDS MONITOR YOUR INCOME MONTHLY FOR A VERY LONG TIME. IF RESTITUTION IS NOT PAID THE COURT CAN FILE NEW CHARGES FOR THIS REASON.
FOLKS, THEIR LIVES WILL NEVER BE NORMAL AGAIN. NEVER. I MEAN NEVER. THEY WILL OWE THIS MONEY AND THEY WILL BE HARASSED BY THE GOVERNEMENT UNTIL THEY ARE PAID IN FULL OR 20 YEARS FROM TH SENTENCING DATE LESS GOOD TIME.
