Appealing is just a way to buy time-and Im hoping his lawyers take him for every cent he has by dragging this out-because thats whats happening. His Lawyers may be requesting house arrest as thats the only place this bottom feeder wont get the beating of his life=== as snitches get stitches and wind up in ditches in prison. In any case house arrest/county jail/jail--after that's over his days in racing are done. If he tries anything he better be like Houdini-because the FBI will be all over this informant scumbag.

I found a resource for you to see actual up to date court records on the Surick case circumventing Pacer which you'd have to sign up and pay for searches:

As per wecandream's question, you not being sure, there is no legal basis to appeal a plea deal that for example Surick's lawyer would of advised and he, Surick agreed and signed.
He could submit a motion to withdraw the plea deal.....but he better have a WORLD CLASS REASON.......FOR EXAMPLE tmbz1 he packs his ass full of nutella, then stands before the judge, says your honor I wasn't of sound mind when I signed this plea deal and reaches in behind his pants and pulls out and spreads some of that nutella all over his mouth and face! Motion granted, plea withdrawn, psych the prisoner! ;D

HIS APPEAL COVERS LEGAL PROCEDURE AND QUESTIONS OF LAW---NOT THE FACTS OF THE CASE AS THEY HAVE ALREADY BEEN DECIDED AND YES, MR. SURICK PLED GUILTY. HE WILL NOT BE PERMITTED TO WITHDRAW HIS PLEA AS HE WAS ADVISED BY REPUTABLE COUNSEL TO PLEA AND HE DID SO. WHAT REASON COULD HE GIVE TO WITHDRAW HIS PLEA????? NONE! He will ultimately serve his time but I agree with the counselor if I had any association with this POS I’d be real concerned. Anyone that knows him, 99% don’t like him but all know this garbage can would rat his own mom out if it would benefit him. THE LAST EXTENSION WAS DUE TO A LANDSCAPING BUSINESS--THIS EXTENSION DOES NOT SAY WHY THERE IS AN EXTENSION. THEREFORE, THERE IS NO FACTS REGARDING THIS--ONLY SPECULATION.

I know if I was going to egage in criminal acitvity such as this, I would want to ensure that all of my co-conspirators had at least as much to lose as me. What kills me about this is the extreme lack of judgement displayed by some of the major players here, working with folks who literally had not much of anything to risk (besides there freedom---which makes them prime candidates to flip when it all goes to shit).
If you are going to be criming, best to do it well...

EFFECTIVE, AUGUST 16, 2023 THE FEDERAL GOVERNMENT HAS SEALED AND FILED 4 DOCUMENTS WITH THE COURT. THE DEFENSE ATTORNEY HAS FILED AND SEALED 3 DOCUMENTS. THE PROSECUTOR AND DEFENSE ATTORNEY AGREED JOINTLY TO WITHDRAW THE APPEAL. IT WAS WITHDRAWN. THEREFORE, ONE WOULD SPECULATE THAT THERE IS MORE TO COME AS THERE IS NO OTHER REASON TO DELAY REPORTING ON THE 5TH OF SEPTEMBER IN FACT THE REPORT DATE WAS DELAYED 3 TIMES AND AGREED TO BY THE FEDERAL PROSEUTOR. THAT IS UNHEARD OF IN THE REAL WORLD.
NOT SURE WHO HE WORKED FOR OR WAS ASSOCIATED WITH BUT I WOULD BE CAUTIOUS AND VERY CONCERNED AS IT IS VERY POSSIBLE THAT THE COOPERATION HAS CONTINUED AND OTHER PARTIES HAVE BEEN DISEMINATED IN ORDER TO ACHIEVE A RULE 5 REDUCTION OF SENTENCE DUE TO A MERITORIOUS RELEASE OF INFORMATION TO THE GOVERNMENT IN A NEW CASE OR ANOTHER EXISTING CASE. SENTENCING IS DELAYED IN ORDER FOR THE GOVERNMENT TO DETERMINE HOW USEFUL THE INFORMATION WAS IN OBTAINING THE INDICTMENT AND CONVICTION IF THERE IS ONE TO BE HAD.
ADDITIONALLY, I DO AGREE WITH OTHERS PRIOR STATEMENTS THAT ONCE AND INFORMANT LIES THE PROSECUTOR IS HARD PRESSED TO USE THE SAME INFORMANT AGAIN UNLESS HARD EVIDENCE IS PRESENTED .
IN THE END THE FEDERAL JUDGE WILL MAKE THE PROPER END DECISION. USUALLY, FEDERAL JUDGES ARE EXTREMELY QUALIFIED TO DO SO AND GENERALLY MAKE THE RIGHT DECISION AS THEY HAVE SEEN AND HEARD IT ALL.
THERE ARE RUMORS OF ANOTHER INVESTIGATION BUT AGAIN I DO NOT HAVE ANY FACTS REGARDING THIS---ONLY RUMORS ALTHOUGH THE SOURCE IS GENERALLY KNOWLEDGIBLE.
